In Mar. 10th 2015, The Institute of Intellectual Property under Civil, Commercial, and Economic Law Department in China University of Political Science and Law (short for IIPL & CCEL) hosted the first academic salon session in 201 Scientific Research Building, XueYuan Campus, CUPL.
Associate Prof. ZuMing Li, the Vice-Director of IIPL, the member of Expert Committee of China Trademark Association, and also the director of Research Center for Geographical Marks CUPL, hosted the academic salon. Prof. XiaoQing Feng was the main lecturer and he was also the Director of IIPL, the Vice-president of China IP Association, and the member of Case Advisory Committee of the Supreme People’s Court. The salon also invited the Vice-president & Prof. of CCEL, XuDong Zhao, as guest lecturer as well as Prof. XiuQing Yang. This academic salon focused on the Draft on Judicial Interpretation on the Authorization and Determination of Trademark Rights, and conduct deep-level discussion and analysis on existing questions and arguments. Participants on the salon includes faculties of IIPL, master or doctorate students in IIPL, and other people who have strong interest in IP issues.
To the very beginning, Prof. Li made brief introduction of salon thesis. He pointed out the revision of China Trademark Law last year imposed substantial impact on both theoretical and practical field. According to the precedent, the Supreme People’s Court would issue judicial interpretation on the trial of trademark cases. While the general judicial interpretation was still the work-in-progress, the Draft on Judicial Interpretation on the Authorization and Determination of Trademark Rights had been released. The draft received suggestion and comment from the public. Because the extent of revision far exceeds the expectation, it was necessary to hold an academic discussion and salon on the subject of trademark judicial interpretation.
After warm welcome and applauds to guesting lecturers, Prof. Zhao and Prof. Yang, the academic salon went into focal stage. Prof. Feng analyzed each provision of the Draft on Judicial Interpretation on the Authorization and Determination of Trademark Rights in detail to all participants. Prof. Feng enlisted three different arguments on the Draft at first. Then the faculties and students conducted heat discussion and delivered distinctive arguments. Based on the discussion and arguments, Prof. Feng concentrated on the general contents of the Draft and made detailed analysis and comments on the following issues: the types of authorization and determination of trademark rights; the examination range by People’s Court; trademark illegal registration; the prohibition of trademark registration; 3D trademark and Well-known trademark. Prof. Feng figured out controversial questions with his own arguments, and communicate with faculties and students on different insights and perspectives.
At last, the salon went into the heated discussion stage. Faculties and students proposed different arguments and innovative ideas in a heartily atmosphere. They focused on several controversial issues on the Draft such as the title and illegal registration. The discussion and arguments were close to theoretical analysis as well as practical issues. As a result, all participants enjoyed a great audio-visual feast.
The academic salon not only provided participants with an interactive platform, but put forth new questions and trigger new thoughts as well as new analysis. To most students, they received valuable knowledge and obtained enlightenment on learning attitude and skills. The salon eventually reached a great success and ended with enthusiastic applauds from all participants.
